Statements in "Intellectual Property - Beiersdorf Defends Blue Hue" at Handelsblatt global

 

When is a color part of a company’s intellectual property? Should it be considered a trademark or not?

Not many companies claim an special colour as their own, as the German Telekom does with "Margenta" for example (others are Milka, Stadtsparkasse, German Post - just to name a few).

 

The Federal Court of Justice (BGH) met to decide if Beiersdorf has sole right to this shade, Nivea blue.

The court ruled that the company must prove that 50 percent of consumers associated this blue with Nivea – the patent court had set that figure at 75 percent before – and ordered a new hearing, sending the case back to the Federal Patent Court in Munich.

The global version of German famous enonomy newspaper Handelsplatt took statements of mine concerning this interessting an ongoing case.
